1. Scope and Provider

These Terms of Use ("Terms") govern your access to and use of Frontpage AI, including our website, mobile application, and all related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Definitions

  • "Service" — The Frontpage AI web application, mobile application, and all associated features, tools, and APIs.
  • "User" or "you" — Any individual who accesses or uses the Service.
  • "Account" — A registered user profile created through our authentication system.
  • "User Content" — Any data, text, prompts, or other material you submit to the Service.
  • "AI Output" — Any content generated by the Service's artificial intelligence features in response to your inputs.

3. Account Registration

3.1. You must be at least 18 years old to create an account and use the Service.

3.2. You must provide a valid email address and create a password during registration. You are responsible for maintaining the confidentiality of your credentials.

3.3. You agree to provide accurate, current, and complete information and to update it as necessary.

3.4. You are solely responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized access or use.

3.5. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of Service

4.1. Frontpage AI provides an AI-powered tool and assistant. The Service may include features such as AI-generated content, text processing, and related functionality.

4.2. The Service is provided on an "as is" and "as available" basis. Features may change, be updated, or be discontinued at any time.

4.3. AI-generated outputs are produced by automated systems. They may contain errors, inaccuracies, or biases. You are responsible for reviewing and verifying any AI Output before relying on it.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You may:

  • Use the Service for personal or business purposes within the scope of available features
  • Access the Service through supported web browsers and mobile applications
  • Store and use AI Output in accordance with applicable law

6. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal, harmful, or fraudulent purpose
  • Generate content that is defamatory, obscene, threatening, or that incites violence or hatred
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Circumvent, disable, or interfere with security features of the Service
  • Use automated scripts, bots, or scraping tools to access the Service without authorization
  • Impersonate any person or entity, or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers and networks connected to the Service
  • Use the Service to develop competing products or services
  • Resell, redistribute, or sublicense access to the Service without our written consent
  • Upload malicious code, viruses, or harmful data
  • Exceed reasonable usage limits or abuse the Service in ways that degrade performance for other users
  • Use AI Output in ways that violate applicable laws, including generating misleading content presented as human-authored

7. Intellectual Property

7.1. Our Property. The Service, including its design, code, features, branding, and documentation, is owned by us and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

7.2. Your Content. You retain ownership of any User Content you submit to the Service. By submitting User Content, you grant us a limited, non-exclusive license to process it solely for the purpose of providing the Service to you.

7.3. AI Output. Ownership of AI-generated content may vary by jurisdiction. To the extent permitted by law, we do not claim ownership of AI Output generated in response to your inputs. You are responsible for ensuring your use of AI Output complies with applicable laws.

8. User Content and AI Output

8.1. You are solely responsible for the User Content you submit. You represent that you have all necessary rights to submit such content and that it does not infringe any third-party rights.

8.2. AI Output is generated automatically and may not be unique. Other users may receive similar or identical outputs from similar inputs.

8.3. We do not guarantee the accuracy, completeness, reliability, or suitability of any AI Output. AI Output should not be relied upon as professional, legal, medical, financial, or other specialized advice.

8.4. We reserve the right to remove User Content or restrict AI Output that violates these Terms or applicable law.

9. Payments and Subscriptions

9.1. Certain features of the Service may require payment. Pricing, billing cycles, and payment terms will be presented to you before purchase.

9.2. Payments are processed by Stripe. By making a payment, you also agree to Stripe's Terms of Service. We do not store your credit card information.

9.3. All prices are inclusive of applicable taxes unless stated otherwise.

9.4. Refunds. Unless required by applicable law (including EU consumer protection law granting a 14-day withdrawal right for digital services), payments are non-refundable. If you are an EU consumer and exercise your right of withdrawal within 14 days of purchase, you are entitled to a full refund, provided you have not fully used the service during that period.

9.5. We reserve the right to change pricing with 30 days' prior notice. Price changes do not affect existing paid periods.

10. Availability and Maintenance

10.1. We aim to provide the Service with reasonable uptime but do not guarantee uninterrupted or error-free operation.

10.2. We may perform scheduled or unscheduled maintenance that temporarily affects availability. We will make reasonable efforts to provide advance notice of planned maintenance.

10.3. We are not liable for any downtime, interruptions, or data loss resulting from maintenance, technical failures, or causes beyond our control.

11. Limitation of Liability

11.1. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

11.2. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim, or EUR 100, whichever is greater.

11.3. Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited under applicable law

11.4. For EU consumers: Statutory consumer protection rights under EU law remain unaffected. These Terms do not limit mandatory consumer rights under Directive 2011/83/EU or national consumer protection legislation.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your User Content
  • Your use of AI Output
  • Your violation of any applicable law or third-party rights

This section does not apply to EU consumers to the extent prohibited by mandatory consumer protection law.

13. Warranty Disclaimer

13.1. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13.2. We do not warrant that AI Output will be accurate, complete, current, or suitable for any purpose.

13.3. For EU consumers: This disclaimer does not affect your statutory warranty rights under applicable EU consumer protection law.

14. Termination

14.1. By you. You may terminate your account at any time by deleting your account through the Service or by contacting us. Upon termination, your right to use the Service ceases immediately.

14.2. By us. We may suspend or terminate your access at any time, with or without notice, if:

  • You breach these Terms
  • We are required to do so by law
  • We discontinue the Service

14.3. Upon termination, we will delete your personal data in accordance with our Privacy Policy, subject to legal retention obligations.

14.4. Sections 7, 8, 11, 12, 13, 15, and 16 survive termination.

15. Dispute Resolution

15.1. Informal resolution. Before initiating formal proceedings, you agree to contact us and attempt to resolve any dispute informally for at least 30 days.

15.2. EU consumers. If you are an EU consumer, you may use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

15.3. Arbitration (non-EU users). For users outside the EU/EEA/UK, any dispute not resolved informally shall be settled by binding arbitration under the rules of the applicable arbitration body in the jurisdiction specified in Section 16, unless prohibited by your local law.

15.4. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for intellectual property infringement or unauthorized access to the Service.

16. Governing Law

16.1. These Terms are governed by the laws of Germany, without regard to conflict of law principles.

16.2. For EU consumers: You will benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.

16.3. For US users: If any class action waiver or arbitration provision is found unenforceable, the remaining provisions of these Terms remain in effect.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original.

18. Changes to These Terms

18.1. We may modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms on our website with a new "Last Updated" date
  • Sending an email notification at least 30 days before significant changes take effect

18.2. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.
